Establishment of a claim for commission
Our claim for commission arises as soon as a main contract regarding the property specified by us has been concluded on the basis of our confirmation/mediation. Concurrent causality of our activity is sufficient here. If the main contract is concluded under conditions other than those originally offered or regarding a different property of the confirmed contracting party, this shall not affect our commission claim, provided that the concluded transaction is commercially identical with the transaction offered by us or only deviates insignificantly from the offered transaction. The occurrence of a stipulated condition subsequent in the main contract shall also leave our commission claim unaffected. The same shall apply if the main contract is cancelled by exercising a contractual right of withdrawal, provided that this is exercised due to reasons that are attributable to a party or reasons lying within a party’s scope of responsibility.  In the case of subsequent invalidity of the main contract for reasons which are not down to the broker, the commission claim shall remain unaffected. The commission claim shall specifically arise in the case of a purchase instead of rental, acquisition of company shares instead of the property and vice-versa, heritable right instead of purchase, or exchange instead of purchase or rental.
